Who regulates private investigators in New Mexico
RLD licenses private investigators, private investigations companies and their employees under the Private Investigators, Private Patrol Operators and Polygraphers Act (NMSA 61-27B) and rules in Title 16, Chapter 48 of the New Mexico Administrative Code. RLD doesn’t issue temporary licenses or extensions.

How to get licensed in New Mexico: step by step
- Document 6,000 hours of qualifying work from the last five years with employer certifications.
- Complete the RLD application with fingerprints, photos and release form.
- Pay the $100 nonrefundable application fee and the license fee (see the fee table).
- Pass the jurisprudence exam.
- If you’ll carry a firearm, complete firearms training, submit your qualification score and instructor number, and provide a psychological evaluation.
- Register any employees with RLD.

Applicants who choose firearm certification must complete the required firearms training, submit their qualification score sheet and the instructor’s registration number, and provide a psychological evaluation under 16.48.2.21 NMAC.
What a private investigator in New Mexico can and can’t do
A PI license is a business license, not police authority. In New Mexico, as everywhere in the U.S., private investigators generally cannot:
- Impersonate law enforcement or claim official authority.
- Trespass on private property to watch or photograph someone.
- Obtain bank, phone or other protected records by pretexting, which federal law prohibits.
- Hack accounts, read someone else’s email or install spyware.
- Place a tracking device on a vehicle where state law forbids it.
- Detain or arrest anyone beyond the citizen’s arrest rights every person has.
On recording, New Mexico is not on the list of all-party consent states in a 2024 legal summary by the law firm Kilpatrick, which generally means one party to a conversation can record it. That does not allow recording conversations you are not part of, and other privacy laws still apply.
What the New Mexico rule requires beyond the license
Under 16.48.2 NMAC, a private investigator applicant needs a jurisprudence exam, a biometric background check and documented qualifying work. Section 16.48.2.9(B) lists 6,000 hours, and 16.48.2.7(D) requires not less than 1,000 hours in the respective area.
A private investigations company needs a licensed manager, a records location in New Mexico and $1,000,000 in general liability insurance (16.48.2.8(A)(1)). The manager needs the exam and a certificate of employment. An employee registration ends with the employment, so it does not travel with the investigator to another company. Firearm certification is optional.

Per 16.48.5 NMAC, all fees payable to the department are non-refundable. Criminal history background check fees are set by the Department of Public Safety and are not included above. Initial terms are three years (16.48.2.27).
